To register, the User must complete a form and provide the requested personal information, in accordance with our Privacy Policy. Once registration is completed, a personal account will be created for the User, which may be used to access the services of the Cannabis Libre Club website and social media channels.

The services of El Milagro Verde S.A.C. allow the User to acquire support products or services for the management of the purchase of medical cannabis products offered by authorized pharmaceutical establishments, through the Cannabis Libre Club website and social media channels, as well as request home delivery service.

By browsing, using, and/or making any purchase, whether without registering or after completing registration, the User unreservedly accepts all provisions contained in these Terms and Conditions, as well as those established by the authorized pharmaceutical establishments, which govern access to and use of the Cannabis Libre Club website and social media channels, for both registered and non-registered Users.

Users of this platform acknowledge that the products and services offered through the Cannabis Libre Club website and social media channels are exclusive to these channels and do not apply to other means and/or sales channels, nor to wholesale or corporate sales.

The support service for the management of the acquisition of medical cannabis products offered by authorized pharmaceutical establishments is an alternative through which Users grant a representative the authority to manage the entire process of obtaining medical cannabis products (coordination of medical consultation, dispensing procedures, and product delivery), as applicable under current regulations. These medical cannabis products are manufactured and dispensed by authorized pharmaceutical establishments, which, at their own account and risk, provide information on the characteristics of their products and sell them directly to Users.

The User who contracts the support service for the management of the acquisition of medical cannabis products offered by authorized pharmaceutical establishments may receive their medical cannabis products at the address indicated for such purposes, provided that the requirements set forth in these Terms and Conditions are met and agreed upon. The personnel assigned as a representative or support will be responsible for handling the dispensing procedures and delivery of the medical cannabis product to the User. Likewise, personnel acting as a representative or support are strictly prohibited from receiving tips and/or gifts.

El Milagro Verde S.A.C. is not the owner of the products acquired through the support service for the purchase of medical cannabis products and, therefore, (i) is not in possession of them, (ii) does not sell them directly to consumers, (iii) does not set offers or promotions, and (iv) does not intervene in the completion of transactions between suppliers and users.

Authorized pharmaceutical establishments shall provide specific indications, where applicable, regarding the origin of the medical cannabis products acquired through the support service, if required. It is not the responsibility of El Milagro Verde S.A.C. to provide such information to the User. Furthermore, any coordination related to such indications must be made directly with the authorized pharmaceutical establishments. El Milagro Verde S.A.C. shall not be responsible for the timeliness or accuracy of such indications, as the authorized pharmaceutical establishments are solely responsible for addressing any breach or inaccurate information.

El Milagro Verde S.A.C. only provides authorized pharmaceutical establishments with a digital platform to offer their products alongside its own and, following the validation of the purchase order (in accordance with Clause 13), the authorized pharmaceutical establishments are responsible for ensuring compliance with the characteristics and specifications offered to the User, as well as all requirements related to the proper commercialization and market placement of their products. In such cases, the User’s personal data will be shared with the authorized pharmaceutical establishments solely for the purpose of issuing the payment receipt, which is generated directly by them.

The role of El Milagro Verde S.A.C. is limited to: (i) providing Users access to the virtual support platform, (ii) collecting and transferring payments made for the acquisition of products, and (iii) fulfilling any other obligations expressly established for El Milagro Verde S.A.C. in these Terms and Conditions.

El Milagro Verde S.A.C. does not guarantee the proper functioning and/or suitability of the medical cannabis products sold by authorized pharmaceutical establishments and assumes no responsibility for any damages and/or losses that may result from the use of products offered by authorized pharmaceutical establishments.

2.1. Validity, Price, and Stock of Medical Cannabis Products

The User acknowledges and accepts that the updating of information regarding products available on our virtual support platform is carried out by El Milagro Verde S.A.C. exclusively based on the information provided by the authorized pharmaceutical establishments.

Accordingly, El Milagro Verde S.A.C. assumes no responsibility for (i) errors, (ii) omissions, or (iii) lack of updates related to prices, validity of offers, and/or stock availability when such information has not been communicated in a timely manner by the aforementioned authorized pharmaceutical establishments.

The support service for booking medical consultations and obtaining prescriptions is offered as a mechanism through which Users may receive assistance from a representative who manages the necessary arrangements with healthcare professionals, in order to facilitate access to virtual medical consultations and the issuance of prescriptions, as applicable and in accordance with current regulations.

The User who contracts this service may schedule and attend their medical consultation through the designated coordination channels and will receive the prescription issued by the healthcare professional, provided that the requirements set forth in these Terms and Conditions are met. The personnel assigned as a representative or support are limited to performing coordination tasks and delivering the prescription to the User, and are strictly prohibited from receiving tips and/or gifts.

El Milagro Verde S.A.C. is not responsible for the medical practice carried out by healthcare professionals, nor for the validity, relevance, or adequacy of the prescriptions issued. Accordingly: (i) it does not intervene in diagnosis, clinical evaluation, or medical prescription, (ii) it does not influence the decision of the healthcare professional, and (iii) it does not guarantee the issuance of a prescription in all cases, as this remains subject to the autonomous assessment of the physician.

Healthcare professionals shall be responsible for scheduling, confirming, and conducting medical consultations, as well as for issuing prescriptions in accordance with applicable regulations. Any disagreement, rescheduling, or breach related to the medical consultation must be addressed directly between the User and the healthcare professional. El Milagro Verde S.A.C. will act, within the scope of its competencies and possibilities, to assist and seek to resolve any issues that may arise.

El Milagro Verde S.A.C. only provides healthcare professionals with a digital platform to offer their services alongside its own. Once the purchase order has been validated (in accordance with Clause 13), healthcare professionals assume full responsibility for compliance with good medical prescribing practices. In such cases, the User’s personal data will be shared with said professionals exclusively for purposes related to the issuance of the corresponding payment receipt, which is issued directly by them.

The role of El Milagro Verde S.A.C. is limited to: (i) providing a virtual support platform that facilitates access to medical consultation bookings and prescription issuance, (ii) collecting and transferring payments related to these services, and (iii) fulfilling any other obligations expressly established in these Terms and Conditions.

El Milagro Verde S.A.C. assumes no liability for any damages, losses, or consequences arising from the content, outcome, or use of the medical consultation or prescription issued by authorized healthcare professionals.

3.1. Booking Process and Requirements

The User acknowledges and accepts that the process for booking a medical consultation and obtaining a prescription requires:

  1. Payment of the applicable fee for booking the consultation, through the available payment methods.
  2. Submission of the User’s personal data and, where applicable, the data of a legal representative, family member, guardian, curator, or safeguard.
  3. Validation and acceptance of such data by the platform’s representative (assigned support crew) and the healthcare professional.

Once the booking is confirmed and the information validated, the healthcare professional will schedule the medical consultation and, if applicable, issue the prescription. Delivery of this prescription will be coordinated with the User at the agreed address and time, with an additional digital copy sent to the contact details provided at the time of booking.

The services of El Milagro Verde S.A.C. are available in certain areas of Metropolitan Lima and Provinces within Peruvian national territory, which may be consulted at: https://www.cannabislibre.club/en/content/1-shipping-and-delivery#coverages-zones-and-costs , and only to those individuals who are legally capable of entering into binding contracts in accordance with applicable law. By accessing the Cannabis Libre Club website and social media channels, the User declares that they are over 18 years of age and are authorized to assume binding obligations with respect to any type of liability arising from the use of the services of El Milagro Verde S.A.C. Any actions carried out by minors on the Cannabis Libre Club website and social media channels shall be the responsibility of their parents, guardians, or legal representatives.

The User undertakes to use the services of El Milagro Verde S.A.C. in accordance with the Law, these Terms and Conditions, morality, good customs, and public order. In this regard, the User’s use of the Cannabis Libre Club website and social media channels shall be carried out in accordance with the following directives:

  1. The User shall not use the Cannabis Libre Club website or social media channels for unlawful purposes, purposes contrary to these Terms and Conditions, purposes harmful to the interests or rights of third parties, or in any way that may damage, disable, impair the platform, or prevent other Users from normally enjoying the services of El Milagro Verde S.A.C.
  2. The User expressly undertakes not to destroy, alter, disable, or otherwise damage the data, programs, electronic documents, or any other content found on the Cannabis Libre Club website or social media channels.
  3. The User undertakes not to obstruct access by other Users through massive consumption of computing resources through which El Milagro Verde S.A.C. provides its services, and not to perform actions that damage, interrupt, or generate errors in the Cannabis Libre Club website or social media channels.
  4. The User undertakes not to attempt to penetrate or test the vulnerability of any system or network belonging to El Milagro Verde S.A.C., nor to breach its security or authentication measures.

El Milagro Verde S.A.C. reserves the right, at its sole discretion, to determine when a breach of any of the above obligations has occurred.

In the event that a User violates the provisions set forth in this section, El Milagro Verde S.A.C. may proceed to take any of the following actions, depending on the seriousness or recurrence of the violation: (i) temporary suspension of the User’s account, (ii) permanent cancellation of the User’s account, or (iii) initiation of civil or criminal liability actions.

For Users who hold an account: At the time of registration, the User declares that the data provided are their own, meaning they must not include another person’s name or provide any personal data belonging to others with the intention of impersonating someone else. In such cases, El Milagro Verde S.A.C. reserves the right to take the corresponding measures if the User attempts to impersonate another person, in accordance with section 4 of this document.

Users who successfully complete their registration will be assigned a personal account with a password, which will allow them to access their account through the Cannabis Libre Club website. Each User is responsible for their own password and must keep it strictly confidential, refraining from disclosing or sharing it under any circumstances with third parties. Any action carried out through a User’s personal account shall always be presumed to have been carried out by the account holder.

If a User identifies that a third party has gained knowledge of and is making use of their password and personal account, they must immediately notify El Milagro Verde S.A.C.

El Milagro Verde S.A.C. shall not be held liable for any damages related to the disclosure of a User’s name or password, or for the use of a User’s name or personal account by any person, where such damages are not attributable to the company and arise from the actions of the corresponding User(s).

El Milagro Verde S.A.C. may take any actions it deems necessary when it considers that an account is no longer secure, including but not limited to the cancellation/termination of the account. An account shall also be deemed insecure when it is associated with:

  1. Transactions reported and/or denounced as fraudulent.
  2. Wholesale purchases (infringement of section 10 of this document).
  3. Use of associated benefits (created exclusively for that purpose).
  4. Improper use of benefits directly.
  5. Complaints or claims regarding a User name that infringes the rights of third parties, such as requests to change a User name and password.
  6. Other reasons arising from the evident misuse of the account.

All intellectual property rights of the Cannabis Libre Club website and social media, including their content and designs, belong to El Milagro Verde S.A.C. or, where applicable, to affiliated companies and/or third parties. In cases where they are owned by third parties, El Milagro Verde S.A.C. holds the necessary licenses or permissions for their use.

The reproduction, distribution, modification, public communication, making available, or any form of use, in whole or in part, of the contents of the Cannabis Libre Club website or social media, in any format and by any technical means, without the authorization of El Milagro Verde S.A.C., is expressly prohibited. The User undertakes to respect the intellectual property rights owned by El Milagro Verde S.A.C., its affiliated companies, and third parties.

Likewise, the use or reproduction of any registered trademark, name, or logo appearing on the Cannabis Libre Club website and social media without the prior written authorization of El Milagro Verde S.A.C. is expressly prohibited.

Additionally, the following practices are also prohibited:

  1. The presentation of a page from Cannabis Libre Club services in a window not belonging to El Milagro Verde S.A.C., through the technique known as "framing".
  2. The insertion of an image published on the Cannabis Libre Club website and social media on a page not belonging to El Milagro Verde S.A.C., through the technique known as in-line linking.

El Milagro Verde S.A.C. provides the User with a personal, free of charge, non-transferable, non-exclusive, and revocable license over the Cannabis Libre Club website software, allowing the User to make use of El Milagro Verde S.A.C.’s services. The software may automatically update with improvements depending on the User’s mobile phone, device, or computer, and in such cases the User’s consent may be required. El Milagro Verde S.A.C. assumes no responsibility in this regard. The User may not modify, alter, manipulate, or perform reverse engineering on the software of El Milagro Verde S.A.C.

In the event that the Cannabis Libre Club website or social media channels contain links or hyperlinks to other Internet sites, El Milagro Verde S.A.C. declares that it exercises no control whatsoever over such sites or their content. Under no circumstances will El Milagro Verde S.A.C. assume any responsibility for the content of any link belonging to an external website or social media platform, nor will it guarantee the technical availability, quality, reliability, accuracy, truthfulness, validity, or compliance with applicable laws of any material or information contained in such hyperlinks or other Internet locations.

El Milagro Verde S.A.C. states that the suspension or interruption of the website does not create any harm or loss for the User, as there is no legal obligation to permanently maintain an active website. Notwithstanding the foregoing, under this clause the User acknowledges that El Milagro Verde S.A.C. shall not be held responsible for any potential damages or losses on the Cannabis Libre Club website or social media channels that may arise from events beyond the control of El Milagro Verde S.A.C., as well as from unlawful intrusions.

Similarly, the Cannabis Libre Club website or app will provide a search tool that enables the User to locate the products and services they wish to purchase. Under no circumstances shall the search tool provide recommendations on behalf of El Milagro Verde S.A.C., nor does it replace the opinion of a physician. It is the sole responsibility of the User to review the main warnings and/or precautions regarding the use of the products and services.

The User of the Cannabis Libre Club website and social media channels may place a maximum of three (03) orders per day, subject to the maximum purchase limits allowed for each category:

• Products offered by El Milagro Verde S.A.C. (over-the-counter):

  • Accessories - maximum of eight (8) units.
  • Devices - maximum of two (2) units.
  • Tools - maximum of two (2) units.

• Products offered by authorized pharmaceutical establishments (prescription only):

  • Medical cannabis products – The Cannabis Libre Club website and social media channels allow the User to request a medical prescription to make purchases accordingly. The expression “Includes Prescription” indicates that the medication is sold exclusively under medical prescription. If the User acquires one or more products under this condition, they expressly acknowledge and accept that they are requesting the coordination of a medical consultation for such purchase and that they must present the prescription at the time of product delivery. The purchase limit for prescription medical cannabis products is up to five (5) units; however, the maximum quantity dispensed and delivered shall be that indicated on the prescription. The User must present the prescription before receiving the order; otherwise, delivery cannot be completed. If the prescription issued authorizes a quantity lower than the one requested by the User in their order, Cannabis Libre Club shall refund the amount corresponding to the products not dispensed, using the same payment method employed by the User at the time of the transaction.

• Medical Consultation Reservations:

  • The User of the Cannabis Libre Club website and social media channels may make a maximum of five (05) medical consultation reservations per day. Each reservation or payment per reservation unit strictly corresponds to the care of one (1) patient, who may be accompanied, if applicable, by their representative, family member, guardian, curator, or safeguard. The User may include more than one reservation within the same purchase order. However, after confirmation of the transaction, the User must provide the identification details corresponding to each patient associated with the reservations made, so that they can be properly processed. The daily limit of five (05) reservations applies both to individual users and to those acting on behalf of third parties. In all cases, the scheduling and performance of consultations shall be subject to the availability of the assigned healthcare professionals and compliance with the requirements established in these Terms and Conditions.

Users have the option to make online payments via "Mercado Pago" to pay for their orders without additional costs using:

  • Credit cards.
  • • Debit cards.
  • Bank transfers.
  • Yape.
  • Cash payments.

The accepted credit and debit cards are:

      • Visa
      • MasterCard
      • American Express

No closed-loop cards (those that do not have the Visa, MasterCard, or American Express logo) will be accepted. After the User has confirmed the order, it is their responsibility to ensure that the selected payment method is available during the purchase process. If the User does not have the indicated payment method, the order cannot be fulfilled.

Products and services offered on the Cannabis Libre Club website or social media platforms, unless otherwise specified for specific cases or product/service offers, can only be paid for using the methods indicated for each case. The use of credit or debit cards is subject to the terms set out in these Terms and Conditions and also those related to the issuing entity, as outlined in the respective contracts with the issuing bank and the fintech company “Mercado Pago.”

In the event of any conflict, the provisions of the latter contract will prevail. For bank cards accepted on the Cannabis Libre Club website or social media platforms, aspects such as issuance date, expiration, blocks, commission fees, installment interest charges, etc., will be governed by the respective contracts with the issuing bank, and El Milagro Verde S.A.C. will not be held responsible for any of these aspects.

When using a credit or debit card, the cardholder's name must match the name used during registration on the El Milagro Verde S.A.C. platform. Otherwise, the transaction may be canceled. In case of suspicion or confirmation of unauthorized purchases, El Milagro Verde S.A.C. will cancel the purchase and void the transaction.

The receipt issued for the User’s order will be a "Boleta de Venta".

El Milagro Verde S.A.C. is responsible for updating and reviewing the stock of products and services displayed on the site solely based on the information provided by authorized pharmaceutical establishments. Nevertheless, it reserves the right to modify or discontinue such products or services at any time, without incurring any liability or obligation to the User.

Both the website and the social media platforms of Cannabis Libre Club are preset to display only those products and services available at the time of the User’s navigation.

Without prejudice to the above, and as set forth in Clause 13, El Milagro Verde S.A.C. reserves the right not to approve a purchase or service request, and consequently not to fulfill an order, if the requested stock is unavailable due to any exceptional circumstance that may have arisen. Any purchase or service request made through the Cannabis Libre Club website or social media will be validated according to stock availability, user data, payment method data, and management capacity. Should any of these validations fail, the purchase or service request will not be processed, and the User will be notified of such rejection via telephone and email (as indicated by the User during the registration process).

Through the Cannabis Libre Club website or social media channels, offers of products and services will be made, which may be accepted electronically using the mechanisms provided by the platform. Any acceptance of an offer shall be subject to the suspensive condition that El Milagro Verde S.A.C. validates the transaction. The receipt by El Milagro Verde S.A.C. of a purchase or service order does not imply its acceptance, nor that the transaction has been validated, nor that the availability of the products or services has been confirmed. Consequently, for any transaction carried out on the Cannabis Libre Club website or social media channels, confirmation and validation or verification by us shall be an essential requirement for the execution of the contract.

To validate the transaction, El Milagro Verde S.A.C. will verify the following “Purchase Conditions”: a) That stock of the products or services is available at the time the offer is accepted; b) That the payment method offered or chosen by the User is valid and accepted; c) That the data registered by the User match those provided when placing the purchase or service request; d) That there is a legitimate purpose of use for the requested products; e) That payment has been credited by the User; and f) That there is management capacity to carry out the delivery or service, in compliance with the “minimum or maximum daily purchase limits” (according to product category), in line with Clause 10 of these Terms and Conditions. It is important that the User remains attentive to any communication, as El Milagro Verde S.A.C. may contact them for the aforementioned validation. As a protective measure for the security of requests and transactions, El Milagro Verde S.A.C. may cancel purchase or service orders if one or more of the Purchase Conditions are not met, particularly those indicated in subsections a, b, c, d, e, and f above. If any of these conditions are not fulfilled, El Milagro Verde S.A.C. will automatically cancel the order as a security measure for the User, notifying them accordingly and issuing a refund through the same payment method used for the purchase, deducting the applicable commission generated by the Mercado Pago payment gateway. For payments made with credit or debit cards, the release of the retained amount will be exclusively subject to the procedures and policies of the issuing financial institution, which shall be solely responsible for executing the refund. El Milagro Verde S.A.C. may cancel any order, as well as annul the corresponding purchase or service order, under the terms described in this paragraph at any time, even after the User has received confirmation of receipt of the order. Additionally, product or service availability cannot be confirmed until the order has been validated, considering any discrepancy between the availability displayed on our website or social media channels and the actual stock of products and services. If the purchase or service request are not approved, El Milagro Verde S.A.C. will notify the User via email and telephone.  

The prices of products and services available on the Cannabis Libre Club website or social media channels, while displayed as available, shall only be valid and applicable on those platforms and shall not apply to other sales channels used by El Milagro Verde S.A.C. and/or its related companies, such as other e-commerce websites, catalogs, or physical establishments. The prices of products and services offered on the Cannabis Libre Club website or social media channels are expressed in Peruvian Soles. Published prices are shown in Soles (PEN) or, where applicable, their equivalent in U.S. Dollars (USD), and correspond solely to the value of the product or service offered. Such prices include the General Sales Tax (IGV) but exclude transportation, handling, shipping, accessories not expressly described, or any other additional item or bank interest charges arising from the payment method used. Prices of certain products or services offered on the Cannabis Libre Club website or social media channels may reflect a typographical error (incorrect price). In such cases, where the purchase appears as completed and the correct price is higher than the price shown on the platform, El Milagro Verde S.A.C. will contact the User via email and telephone to inform them and obtain their consent regarding the correct price. If the User cannot be reached or does not provide consent to the correct price within twenty-four (24) hours of notification, the order will be canceled, and the User will be informed by email and telephone at the contact details provided.

The User may choose to receive their order at the address indicated for such purposes, as long as the Purchase Conditions set forth in this document are met.

The validity period of an offer is the one that coincides with the expiration date indicated in the promotion or by the exhaustion of the quantities of products or services (stock) available for that promotion, duly informed to the User, or as long as the offer of the service remains published and available, whichever comes first.

The promotions offered on the Cannabis Libre Club website or social media are not necessarily the same as those offered through other sales channels used by El Milagro Verde S.A.C., unless expressly stated on the Cannabis Libre Club website or social media or in the advertising made for each promotion. When the Cannabis Libre Club website or social media offer promotions that include the free or reduced-price delivery of a product with the purchase of another, the promotional product will be delivered to the same address as the purchased product. The Cannabis Libre Club website and social media promotions and promotional activities are subject to compliance with applicable regulations. The prices of certain promotions offered on the Cannabis Libre Club website or social media may reflect a typographical error (incorrect price). In cases where the promotion purchase is shown as completed but the correct price is higher than that displayed on the website or social media, El Milagro Verde S.A.C. will send an email and phone communication to the User to inform them so that they may confirm acceptance of the correct price. If it is not possible to contact the User or their confirmation of the correct price is not obtained within twenty-four (24) hours of the communication, the order will be canceled, and the User will be notified thereafter at the email and phone number provided as their contact details.

The User expressly accepts that the telephone number and email address provided in the registration form shall be the official means of contact between the User and Cannabis Libre Club or El Milagro Verde S.A.C. The User is exclusively responsible for ensuring that such email address and telephone number remain active and functional in order to receive all communications from Cannabis Libre Club or El Milagro Verde S.A.C.

Messages or communications from Cannabis Libre Club or El Milagro Verde S.A.C. to Users may only originate from official websites or accounts. Should it be detected that any User is sending communications or making publications on behalf of Cannabis Libre Club or El Milagro Verde S.A.C., corrective and legal actions will be initiated in order to protect other Users from potential risks of confusion.

El Milagro Verde S.A.C. will not be held responsible for any delay or failure in performance or interruption of the Cannabis Libre Club website or social media platforms that may result directly or indirectly from any cause or circumstance beyond its reasonable control, including, but not limited to, failures in electronic or mechanical equipment or communication lines, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labor problems, wars, or government restrictions.

Additionally, El Milagro Verde S.A.C. is always working to ensure the availability and timely delivery of products and services within the offered timeframe; however, we inform all our users that our business activities are subject to compliance with government regulations. These may be affected at any time by cases of force majeure (as stipulated in the previous paragraph and in accordance with the provisions of Article 1315° of the Peruvian Civil Code – Legislative Decree Nº.295), in which case we will be entitled to cancel the purchase order and refund the payment made.

In accordance with the provisions of the Consumer Protection and Defense Code, Law Nº.29571, El Milagro Verde S.A.C. makes available to Users a virtual Complaint Book so that they can formally record their complaints or claims regarding El Milagro Verde S.A.C.’s services. El Milagro Verde S.A.C. cooperates with competent authorities and third parties to ensure compliance with the law. El Milagro Verde S.A.C. may disclose the personal information of Users of its services upon request from judicial or governmental authorities, to the extent deemed necessary, for investigations carried out by them, especially in the case of criminal or fraud investigations, or those related to computer piracy, copyright violations, intellectual property rights infringements, or other illegal activities that could expose El Milagro Verde S.A.C. or its Users to any legal liability.

Additionally, El Milagro Verde S.A.C. reserves the right to share information about its Users with other Users, entities, or third parties when there are sufficient grounds to believe that a User’s activity is suspected of attempting or committing a crime or attempting to harm others. This right will be used at the sole discretion of El Milagro Verde S.A.C. when it deems it appropriate or necessary to maintain the integrity and security of the Cannabis Libre Club website and social media platforms, to enforce these Terms and Conditions, and to assist in the enforcement of the law. 

Users expressly authorize the assignment of these Terms and Conditions in favor of any person who (i) becomes bound by these Terms and Conditions and/or (ii) becomes the new controller of the database containing the User’s personal information. Once the assignment has taken place, El Milagro Verde S.A.C. shall have no liability whatsoever regarding any event occurring from the date of the assignment onward. The new controller shall assume each and every obligation set forth in these Terms and Conditions and in the Privacy Policy with respect to the processing, safeguarding, and preservation of the User’s personal information.

These Terms and Conditions are governed by Peruvian law, and any dispute arising concerning the validity, application, or interpretation thereof, including the Privacy Policy, shall be resolved in the courts of the Republic of Perú.

The User of the Cannabis Libre Club website and social media platforms may request a change, return, or cancellation, subject to the conditions allowed for each product category:

22.1.     Conditions for Products Offered by El Milagro Verde S.A.C. (Over-the-Counter):

The provisions set forth in this clause 22.1 apply exclusively to cases where the User, even though the product was delivered without any issue, wishes to return or exchange it without stating a reason; this refers to a right of withdrawal or reconsideration that our company voluntarily grants to Users on the basis of its satisfaction guarantee policies, provided that the conditions indicated below are met. These provisions/conditions do not apply to changes or returns to which the User may be entitled by law due to the product having been delivered with a defect or issue. Therefore, they do not exclude or limit the legal rights granted to consumers.

Exchange/Return Process

To be eligible for an exchange and/or return of an over-the-counter product purchased, the User must comply with the following requirements:

  1. Submit the request within twenty-four (24) hours of delivery.
  2. Provide proof of purchase, which must be presented/sent at the time of the exchange/return.
  3. The product(s) must be verified by personnel assigned by El Milagro Verde S.A.C., as applicable, and must not have been used, consumed, damaged, or tampered with in any way that affects their “new” condition. They must be complete, in their original packaging, with legible labels and accessories, if applicable.

If the User meets the above requirements, they have the following options:

  1. Request an exchange of the product for another identical one, provided that El Milagro Verde S.A.C. has stock available; or for a different product of equal value using the already paid amount.
  2. Request a full refund.

Refund of Money

If the User requests a refund, they may choose between:

  1. A refund through the same payment method used for the purchase, minus the applicable commission charged by the Mercado Pago payment gateway.
  2. In the case of card payments, the time for the refund will depend on the User's banking institution.

Product Exchange

For purchases made through the Cannabis Libre Club website and social media platforms under the home delivery (Delivery) service, if the User requests a product exchange, El Milagro Verde S.A.C. will collect and replace the product(s) at the address indicated by the User (at no additional cost if the product was delivered with an issue). If the product was delivered without any issue and the User still wishes to proceed with the exchange, any additional transportation costs generated by this process shall be borne by the User. It is the User’s responsibility to be at the address on the date and time scheduled. If the User is not present, they must coordinate a new delivery date. The User may reschedule the delivery a maximum of two (02) times.

Transport or Delivery Personnel

The transport personnel responsible for collecting and delivering the product exchange are under no circumstances authorized to inspect and/or manipulate the product; their only role is to verify the requirements necessary to collect it and deliver the replacement product. Transport and Delivery Personnel are strictly prohibited from accepting tips.

Cancellation by the User

In the event the User makes an error in the purchase request (error in delivery address, personal data, product quantity, among others), they must cancel the purchase immediately and proceed with a new request.

22.2.     Conditions for products offered by authorized pharmaceutical establishments (Prescription Only):

Without affecting the foregoing, changes or refunds are not accepted for cannabis-based medical products offered by authorized pharmaceutical establishments due to the nature of the acquisition of such products.

If the User makes an error in the support service request (e.g., delivery address, personal data, product quantities, among others), they must immediately cancel or annul the service request and proceed with a new one.

The User has the option to cancel their order at any time via:

El Milagro Verde S.A.C. expressly reserves the right to modify, update, or expand these Terms and Conditions at any time.

Any modification, update, or expansion made to these Terms and Conditions will be immediately published through this medium, and it is the User's responsibility to review the current Terms and Conditions at the time of navigation.

If the User does not agree with the aforementioned modifications, they may choose not to use the Services of El Milagro Verde S.A.C.

It is noted that the Terms and Conditions in effect at the time of the transaction with the User will be respected.
